Family Law Modifications in Corona

Aggressive Advocacy & Compassionate Guidance for Custody & Support Changes

Existing family court orders may no longer fit after a substantial change in a parent’s finances, living arrangements, or family circumstances. At Michael J. Lacilento, Attorney at Law, I represent Corona, California parents and former spouses seeking modifications to child custody, child support, and spousal support orders.

I bring 20 years of legal experience to family law matters. I take an aggressive approach when courtroom advocacy is necessary while providing compassionate, client-centered guidance outside court. My broader practice includes divorce, property division, paternity, guardianship proceedings, and matters involving Child Protective Services and juvenile dependency issues.

California Standards for Modifying Family Court Orders

California courts apply different standards to custody and financial support requests. A modification isn’t automatic because circumstances have become inconvenient or the parties prefer a different arrangement. The person requesting the change generally must present evidence that meets the standard governing the order.

Child Custody Modification

A parent requesting a child custody modification generally must show a significant change affecting the child’s best interests. Relevant considerations can include each parent’s capabilities, age, health, and habits. The court may also consider disruption to the child’s current circumstances and the preference of a child age 14 or older, although no single consideration necessarily controls the decision.

Relocation, substance abuse, domestic violence, remarriage, and other new family circumstances may be relevant when they affect custody or a child’s welfare. Whether those facts justify changing an order depends on the evidence and the court’s assessment of the child’s best interests.

Child Support Modification

Changing child support generally requires a material shift from the circumstances behind the last order. California’s child support guideline considers each parent’s net disposable income and the percentage of time the child is in each parent’s physical custody. A substantial income change or adjustment to the custody timeshare can therefore affect the calculation.

Spousal Support Modification

A request to change spousal support also generally depends on a material change since the existing order. The inquiry focuses on the parties’ financial circumstances and the terms of the current order. Because the facts and prior orders differ from case to case, I evaluate the specific history before recommending a strategy.

Evidence That May Support a Modification

A modification request should connect the requested relief to developments since the court entered its prior order. The existing order establishes the starting point, while records and testimony can show the timing, extent, and continuing effect of the new circumstances.

Relevant financial changes may include:

  • A job loss or another material change in income
  • A substantial change in the parenting-time share
  • A new child support obligation
  • A change in health insurance costs

Evidence may include income records, expense information, insurance documentation, and records showing the actual custody schedule. In custody matters, communications, school or medical records, and other admissible evidence may help establish a relocation, safety concern, or development affecting the child’s welfare. These circumstances can support a request, but they don’t guarantee that a judge will modify the order.

The California Court Modification Process

A party commonly begins the process by filing a Request for Order, Form FL-300. Financial modification matters also generally require an Income and Expense Declaration, Form FL-150. The requested terms and supporting facts should be stated clearly so the court and the other party understand the proposed change.

The requesting party generally must serve the other party at least 16 court days before the hearing. Additional timing requirements may depend on the method of service and court procedure. At the hearing, the requesting party presents evidence of what has changed and explains why the proposed modification satisfies the applicable legal standard.

Emergency Custody Requests

When a child faces immediate danger, California law provides a process for requesting an emergency ex parte order. Ex parte means the court considers an urgent request on an accelerated basis, sometimes before a standard noticed hearing can occur. The court decides whether the facts and evidence justify emergency custody relief.

Timing of Child Support Changes

A change to child support is generally retroactive to the date the Request for Order was filed, not the date the underlying circumstances arose. Delaying a filing can therefore affect the period covered by a potential adjustment. The court’s decision and the effective date remain dependent on the case circumstances and applicable law.
