What are the Penalties for DUI in California?

What are the Different Field Sobriety Tests?

In the state of California if you are pulled over for a DUI the office will administer one of The Standardized Field Sobriety Tests (SFST):

  • Horizontal Gaze Nystagmus (HGN) test - In this test the officer will slowly move a pen or small object back and forth look for indicators in each eye that the person is impaired.
  • Walk-and-turn test - In this test, the officer instructs the person to take nine steps, touching heel-to-toe in a straight line and the return back.
  • One-leg stand test - In this test, the officer will ask the person to stand with one foot off the ground and hold it for about 30 seconds or so.

What is the Purpose of a Field Sobriety Test?

The purpose of these tests is to help the officer determine if the person is under the influence of drugs or alcohol. The officer is looking for common signs that the person is intoxicated such as not being able to keep their balance, starting before the instructions are finished or not following the instructions properly.
