What is the Difference Between Spousal Support and Alimony?
Spousal support and alimony are not the same. Alimony concerns payments given to one spouse during the divorce or shortly after as a way to rehabilitate that spouse after the separation. Spousal support comes in two forms: temporary and permanent.
- Temporary spousal support can be obtained while the divorce is still pending.
- Permanent spousal support is not actually permanent. It is spousal support that is set up to be paid in monthly installations and can end when the spouse gets married or the support is no longer needed. Spousal support cannot be terminated without a court order.
How is Spousal Support Calculated in California?
The courts use a variety of different circumstances to determine how much spousal support should be collected.
Some of the factors they consider when making this decision are:
- Both spouse's incomes
- Each spouse's earning capacity
- Any sacrifices the requesting spouse made for the marriage
- The standard of living prior to the divorce
- The requesting spouse's ability to sustain him or herself
After evaluating these and other factors, the court will either declare or deny spousal support and affix an amount. Once spousal support is declared, it is mandatory. This means you can't just ignore the obligation to make payments. Instead, you are fully expected to make all payments regularly or you can be severely penalized by the courts.
