Spousal Support in Corona, California

Spousal support payments aren't mandatory in all California divorces. Contrary to popular belief, they are also now permanent. You don't have to request spousal support, and if both spouses have self-sustaining jobs, then the payments may not be necessary.

Still, many divorcees decide to seek spousal support in court. Spousal support can become quite a battle, so it is important to have a legal advocate on your side who is comfortable in the court room. I am an aggressive attorney who has a reputation as a serious litigator. I can fight on both sides of the spousal support battle, either advocating for support or helping you to argue against support.

Spousal Support vs. Alimony

Spousal support and alimony are not the same. Alimony concerns payments given to one spouse during the divorce or shortly after as a way to rehabilitate that spouse after the separation. Spousal support comes in two forms: temporary and permanent. Temporary spousal support can be obtained while the divorce is still pending.

Permanent spousal support is not actually permanent. It is spousal support that is set up to be paid in monthly installations and can end when the spouse gets married or the support is no longer needed. Spousal support cannot be terminated without a court order.

Calculating Spousal Support

The courts use a variety of different circumstances to determine how much spousal support should be collected.

Some of the factors they consider when making this decision are:

  • Both spouse's incomes
  • Each spouse's earning capacity
  • Any sacrifices the requesting spouse made for the marriage
  • The standard of living prior to divorce
  • The requesting spouse's ability to sustain him or herself

After evaluating these and other factors, the court will either declare or deny spousal support and affix an amount. Once spousal support is declared, it is mandatory. This means you can't just ignore the obligation to make payments. Instead, you are fully expected to make all payments regularly or you can be severely penalized by the courts.

Let my firm assist you with your spousal support matter. Whether you are seeking support or trying to avoid paying it, I can represent you in your case and fight for your goals. Call today!
